Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the getdac7.eu website and the services offered therein (the "Service") operated by Marcel Goria, IČO: 08722536, a self-employed person registered in the Czech Republic ("us", "we", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms.

1. The Service

getdac7.eu provides a Software-as-a-Service (SaaS) platform designed to assist digital platform operators ("Customers") in complying with the EU's DAC7 directive. The Service includes, but is not limited to, tools for data validation and generation of compliant XML reports (the "Features").

2. Accounts and Access Fees

When you create an account with us, you guarantee that you are above the age of 18 and that the information you provide us is accurate, complete, and current at all times.

Our Service is billed as a one-time annual access fee per reporting year. You will be charged once for access to the Service for a specific reporting year (e.g., 2024, 2025). This is not a recurring subscription and does not automatically renew. If you wish to use the Service for a subsequent reporting year, you will need to make a separate purchase for that year. You may generate unlimited DAC7 XML files during your purchased access period.

3. Customer Obligations

As a Customer, you are responsible for:

Providing accurate and lawful data (both "Platform Data" and "Seller Data") to the Service.
Ensuring you have a legal basis for collecting and providing the Seller Data to us for processing.
Maintaining the confidentiality of your account and password.
All activities that occur under your account.

You represent and warrant that you are the "Data Controller" for the Seller Data you provide to the Service and that you have all necessary rights and consents to provide this data to us for processing.

4. Data Processing

To the extent that we process any personal data on your behalf that is subject to the General Data Protection Regulation (GDPR), you agree to the terms of our Data Processing Agreement (DPA), which is located at https://getdac7.eu/dpa.

This DPA is hereby incorporated by reference into and made a part of these Terms of Service. By agreeing to these Terms, you are also legally agreeing to the terms of the DPA.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Marcel Goria, IČO: 08722536 and its licensors. Our trademarks may not be used in connection with any product or service without our prior written consent.

You retain all ownership rights to the Customer Data you provide to the Service.

6. Limitation of Liability

In no event shall Marcel Goria, IČO: 08722536, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Our Service is a compliance tool, but we are not a tax or legal advisory firm. You are ultimately responsible for your own tax and legal compliance.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law provisions.

9. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect.
